Terms and Conditions of Access, Use and Purchase of Products in the Autonomous Store

These Terms and Conditions apply to the access, use and purchase of products in the Autonomous Store operated by Glow – Produtos Farmacêuticos, Lda. ("Pharma&Go"). Entering the store implies prior reading, acknowledgement and full and unreserved acceptance of these Terms and Conditions.
  1. 1. General Information

    1.1. The Autonomous Store's technology is the property of SENSEIDATA, S.A. ("Sensei"), a public limited company incorporated under Portuguese law and registered with the competent authorities under number 514 507 250, with registered office at Rua da Senhora de Mércules, lote 8, loja 2, 6000-280 Castelo Branco, Portugal.

    1.2. Glintt Global, S.A. ("Glintt") is the company responsible for the resale of the products and services required for the OPERATOR to use Sensei technology in a Store.

    1.3. Glow – Produtos Farmacêuticos, Lda. (the OPERATOR), the entity responsible for supplying the products and using the Sensei technology in the Autonomous Stores, is a company incorporated under Portuguese law and registered with the competent authorities under number 509 041 620, with registered office at Av. Vale de Milhaços, 34, 2855-386 Corroios, Portugal.

  2. 2. Object

    2.1. These Terms and Conditions are the responsibility of the OPERATOR and govern the rules for access to and use of the Autonomous Stores, where products are purchased through the Sensei system without the intervention of customer service staff or cashiers.

    2.2. Access, use and purchase of products in the Autonomous Stores presuppose the reading, acknowledgement and full and unreserved acceptance of these Terms and Conditions.

    2.3. Any changes to these Terms and Conditions will be duly updated at the respective Autonomous Store locations.

  3. 3. Access, Use, Purchase of Products and Billing

    3.1. Access to and use of the Autonomous Store is carried out through a check-in process, by reading the Customer's bank card (debit or credit) and full and unreserved acceptance of these Terms and Conditions.

    3.2. Once this procedure is complete, the Customer may enter the Autonomous Store through the entrance gate, select the product(s) they wish to purchase, remove them from the shelf and head to the exit gate.

    3.3. Any products removed from the shelf that the Customer does not wish to purchase must be returned to their original place before leaving the store. Failure to do so may result in their purchase being charged.

    3.4. Upon exiting the Autonomous Store, the purchase amount will be charged to the payment method (debit or credit card) selected during check-in. If the Customer wishes to receive confirmation by SMS or email, or an invoice with their tax number, they must, before exiting, associate their mobile number or email, provide their tax number and request a receipt at the screen located by the exit door.

    3.5. The interior of the Autonomous Store is covered by an integrated camera system, used solely for the provision of the service.

    3.6. The Customer is solely responsible for the use of the service and for payment of amounts due in respect of products purchased, as well as for any damage caused to the store or to the goods within it. These Terms and Conditions also apply to every individual entering the store with the Customer, including children and other adults.

  4. 4. Products and Prices

    Product prices are shown on the labels and include VAT at the legal rate in force in Portugal. Products are made available in accordance with the applicable food and pharmaceutical legislation, where relevant.

  5. 5. Cancellation and Refunds

    Under applicable legislation, the Customer does not have the right to return purchased products after leaving the Autonomous Store. Purchases may only be cancelled in the event of a definitive interruption of the purchase process due to technical or operational reasons attributable to the OPERATOR.

  6. 6. Protection of Personal Data

    6.1. The OPERATOR is the entity responsible for processing the personal data provided by the Customer or generated through the use of the service, for the purposes of access, use, purchase of products and billing, under the terms described above.

    6.2. The personal data referred to above will be processed by the OPERATOR in order to provide the service and for the following purposes:

    • to allow the Customer to use or access the Autonomous Stores;
    • to manage the use of the Autonomous Store without a cashier or customer service intervention;
    • to send the confirmation/summary of the purchase and issue the invoice;
    • to manage any complaints.

    6.3. Based on the OPERATOR's legitimate interest, and safeguarding the rights and freedoms of users, the OPERATOR may also process personal data for fraud prevention and detection and for the provision of technical support.

    6.4. The Customer's personal data will be retained for as long as necessary for the purposes for which it is processed, considering legal requirements, necessity and data minimisation.

    6.5. Under applicable legislation, the Customer has the right to access, rectify, object to, erase and restrict the processing of their personal data. The Customer may also contact the Data Protection Officer regarding any data protection matter via the OPERATOR's email address.

    6.6. Where the Customer has given consent, this consent may be withdrawn at any time. Withdrawal does not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal.

    6.7. The Customer can obtain information about the OPERATOR's Privacy Policy and data processing on the OPERATOR's website.

  7. 7. Intellectual Property

    7.1. All intellectual property rights over the technology developed for the Autonomous Stores are and will remain the exclusive property of Sensei, and the promotion and use of the Technology under these terms will not infringe third-party intellectual property rights.

    7.2. The user/customer is not entitled to use the contents of the Autonomous Stores for any purposes other than those provided for in these Terms and Conditions.

    7.3. The Autonomous Stores, including their products and services, are protected by intellectual property rights (copyright and industrial property rights) and the applicable legislation, which the user is obliged to respect.

  8. 8. Limitation of Liability

    The OPERATOR shall not be liable for any damage or costs resulting from:

    • use of or inability to use the service, including delays, interruptions, errors, interference, suspensions, omissions or malfunctions of the Autonomous Store;
    • delays or blockages caused by deficiencies or overloads in the banking or communications systems;
    • unauthorised actions by third parties;
    • force majeure events, i.e. unforeseeable events beyond the OPERATOR's control that prevent or hinder the timely fulfilment of its obligations;
    • unauthorised access to and use of personal data;
    • negligent or abusive use of the Autonomous Store, including where the Customer fails to ensure the door is properly closed immediately after the purchase.
  9. 9. Communications

    Without prejudice to other forms of communication provided for in these Terms and Conditions, for any clarifications please contact: support@pharmaandgo.com.

  10. 10. Changes to the Terms and Conditions

    These Terms and Conditions may be amended by the OPERATOR without prior notice. Users should review the Terms and Conditions regularly to stay informed of any changes.

  11. 11. Law and Jurisdiction

    11.1. These Terms and Conditions are governed by Portuguese law.

    11.2. In the event of any dispute, the OPERATOR and the Customer agree on the jurisdiction of the Lisbon courts. The Customer may also submit disputes to one of the Consumer Conflict Arbitration Centres available under Alternative Dispute Resolution, with further information at www.consumidor.gov.pt.

    The Customer declares that they have read and fully accept, without reservation, these General Terms and Conditions of Use.
